Respected Madam,
It is revealed during our fact finding upon information received that the victim girl was abducted and her family members strongly suspected that she was made victim of immoral trafficking. The victim is of a marginalized muslim community residing under Swarupnagar Police Station, North 24 Parganas district.
It is revealed that no criminal case was started by the police. Whereas in the complaint of the family members of the victim girl clearly mentioned an incidence of immoral trafficking under 5A of the Immoral Traffic Prevention Act 1956 as the perpetrator induces the victim girl to go from any place, with the intent that she may for the purpose of prostitution become the inmate of, or frequent, a brothel; and abduction to induce a woman to compel her for illicit intercourse under section 366 Indian Penal Code.
The family member of the victim girl had been repeatedly visiting Swarupnagar Police Station for past few months begging to rescue their girl from the brothel of Mumbai. But even after getting informed where the girl is the police ill-treated the victim's family time and again thus the Investigating Officer of the said case, undoubtedly violating the directives under regulation 33 of Police Regulation of Bengal 1943.
The life of the victim girl is at threat for the inaction of the police authorities, and she was still to be rescued from the clutch of the traffickers. Consequently, the family member's pain and anxiety is increasing. This is yet another case of harassment and torture by the police officials. Till date the investigation is yet to move towards any affirmative action.
Hence, we seek your urgent intervention in this matter in the following manner:
· Concerned police authorities are to be directed to take action immediately to rescue the trafficked victim and also take necessary legal action against the accused persons;
· The police should file an FIR under 5A of the Immoral Traffic Prevention Act 1956and start a criminal case against the accused.
· An impartial and independent investigation is to be initiated against the perpetrator police officials and stern judicial action is to be taken against them;
· Appropriate rehabilitation and compensation is to be provided to the victim.

Particulars of the victim:- Ms. Rehana Khatun (name changed) daughter of Arsad Gazi, village- Taranipore, Police Station-Swarupnagar, District-North 24 Parganas, West Bengal.
Name of the perpetrators: - (1) The Officer-in-Charge of Swarupnagar Police Station; (2) The Investigating Officer of Swarupnagar Police Station GDE no. 1022 dated 21.04.2011 (3) Mr. Rajjak Mondal son of Yunis Ali Mondal,Village Dekutia,Police Station Swarupnagar District-North 24 Parganas, West Bengal.
Case Details:-
It is revealed during fact finding that the victim girl was abducted by Mr. Rajjak Mondal of village-Dekutia, Police Station-Swarupnagar, District-North 24 Parganas by inducing the victim girl. On 16/04/2011 when the victim was going to her friend's house Mr. Rajjak Mondal abducted her from open road near Taranipore Market. It is presumed by her family members that Mr. Rajjak Mondal abducted her with the particular intention to have sexual relation.
It is also revealed that Mr. Rajjak Mondal is alleged to be a person who is habitually involved in flesh trade and women trafficking. The family members of the victim girls strongly suspected that she was abducted by the accused persons for the purpose of immoral trafficking. On 14/05/2011 the victim girl even telephoned her family members from one mobile number (09673174910) and let them know that she was detained in Mumbai. She even informed her family members that Mr. Rajjak and his associates tortured her a lot and sold her for the purpose of prostitution.
The victim's family went to lodge a written complaint at Swarupnagar Police Station against the person as mentioned above being involved in abduction and immoral trafficking of the victim girl on 21/04/2011. Police registered that only one information (GDE No 1022 dated 21/04/2011). However the police refused to register any specific crime even after requested by the family members of the victim many times on the ground that the victim was not a minor at the time of abduction which is completely illegal. They even harassed the family members of victim a lot by different ways. The police even showed their anguish towards the victim's family for agitating their plea time and again to recover the victim girl.
The victim's family tried to bring the attention of the Superintendent of Police, North 24 Parganas district at Barasat on the explicit negligence of the involved police personnel of Swarupngar Police Station to recover the victim girl and take steps against the accused person by filing a written complaint on 28/07/2011. But the situation did not progress an inch as there has been no response from the aforesaid authority even after receiving the complaint from the victim's family. The police neither arrested the accused persons nor recovered the victim girl till date.
