NEW DELHI: India's HIV control programme could soon get merged with the country's flagship National Rural Health Mission (NRHM), if the
Planning Commission has its way.

The Commission's steering committee on health for the 12th five-year Plan has proposed "incorporating AIDS control, universal healthcare and universal access to essential medicines" into NRHM.

Planning Commission member in-charge of health Syeda Hameed said, "It is a serious recommendation to incorporate NACO under an overall National Health Mission rather that a single vertical programme."

The proposal, however, has left both the Union health ministry and the National AIDS ControlOrganization (NACO) unhappy.

Union health secretary P K Pradhan said, "We have told the Planning Commission that this recommendation cannot work. AIDS control is a specialized issue, and needs focused attention."

Pradhan added that AIDS control cannot be carried out by Auxiliary Nurse Midwives (ANMs).

"Containing AIDS and HIV in India will require dealing with sex workers, injectible drug users, transgenders and men who have sex with men. It is a different clientele compared to the work that ANMs do now. We are not in favour of the merger," Pradhan added.

Hameed, however, disagrees.

She argued, "It's all about training the ANMs on how to carry out AIDS control. We, however, don't want to burden them too much. The steering committee report will undergo three levels of approval. We are confident of pushing it through."

The steering committee report says "Impressive gains made by national health programs, including NRHM and other disease control programs, now need to be channeled to deliver Universal Healthcare in all urban and rural areas during the 12th Plan period."

It adds, "The process should start during the first year of the plan itself with Universal Healthcare pilots being run in one district of each state and UT. Concurrently, the management structure of national health programmes needs to take steps to prepare for UHC. Key recommendations on this transition is reorienting from vertical disease based approach to a holistic, health promotion strategy based on strengthening of health systems."

The panel says the B K Chaturvedi Committee on Restructuring of Centrally Sponsored Schemes has also recommended merger of individual disease control programmes.

"The NRHM governance structure should be used to provide leadership to all the national health programmes. Operations under national disease control programmes should be harmonized under NRHM so as to avoid duplication and provide convergent services in a cost-effective manner," the report says.

India launched the first National AIDS Control Programme (NACP I) in 1992, while NACP II was initiated 1998. NACP III (2007-2012) was designed with the prime objective to "halt and reverse the HIV epidemic in India" by the end of the project.

There has been a steady decline in overall prevalence, and nearly 50% dip in new infections over the last 10 years.

Most of NACP III was funded by external partners like the Bill and Melinda Gates Foundation with domestic budgetary support to the department of AIDS control being less than 5% of the department's budget.

The estimated number of new annual HIV infections has declined by more than 50% over the past decade. It is estimated that India had approximately 1.2 lakh new HIV infections in 2009 as against 2.7 lakh in 2000.

Odisha, Bihar, West Bengal, Uttar Pradesh, Rajasthan, Madhya Pradesh and Gujarat account for 41% of new infections. The adult HIV prevalence at national level has continued its steady decline from estimated level of 0.41% in 2000 through 0.36% in 2006 to 0.31% in 2009.

New Report Outlines Blueprint For Transgender Equality


The National Center for Transgender Equality has released a new "Blueprint for Equality" that outlines 99 steps that could be taken to advance the lives of transgender Americans. The report highlights various areas of concern for transgender people and the ways policies do not currently ensure transgender protection:

ECONOMIC OPPORTUNITY: "Passing a federal law to prohibit gender identity discrimination in the most specific terms is essential to ensuring that employers understand and consistently follow the law, and therefore to eliminating anti-trans discrimination."

HOUSING AND HOMELESSNESS: "Whether it is fair participation in the rental and homebuying market or access to homeless shelters, the pervasive nature of discrimination follows trans people home."

SAFE AND SUPPORTIVE SCHOOLS: "Bullying and violence in schools constitute a safety crisis, impacting the health and educational achievements of transgender and gender nonconforming youth."

ACCESS TO QUALITY HEALTH CARE: "In a groundbreaking 2011 report, the U.S. Institute of Medicine (IOM) found that transgender people in the United States face serious health disparities and systemic barriers to care… At the same time, transgender people are more likely to be uninsured, to be unable to afford to pay for health care out of pocket, and to delay seeking health care because of cost or fear of discrimination."

FIGHTING HIV/AIDS: "Overall, transgender people face HIV infection rates many times higher than the general population, and rates for transgender people of color are even higher. Estimates are that one in four Black transgender people in the U.S. is living with HIV/AIDS. Discrimination, stigma, social isolation, bias among health and social service providers, and a lack of targeted prevention efforts have all contributed to these high levels of infection."

ENDING ANTI-TRANSGENDER VIOLENCE: "Transgender people today face an epidemic of antitrans violence. Whether it occurs on our streets, in our schools, in our homes, or even comes from law enforcement or other officials, staggering levels of violence persist even as trans equality advances."

IMPROVING THE LIVES OF TRANS OLDER ADULTS: "According to the national Caring and Aging with Pride survey, transgender older adults are a 'critically underserved population at heightened risk of physical and mental health disparities often combined with less social and community support.'"

COUNTING TRANS PEOPLE IN FEDERAL SURVEYS: "We need data about the lives of transgender people that is comprehensive, systematic, and collected regularly on a large scale."

ID DOCUMENTS AND PRIVACY: "Government should not compel unnecessary or unaffordable medical procedures for purely bureaucratic purposes, nor should it needlessly compel the disclosure of a person's medical history or transgender status."

THE RIGHT TO TRAVEL: "While NCTE has long worked with TSA to promote better staff training, respond to individual complaints, and educate the trans traveling public, the agency's lack of transparency and persistent use of invasive and unproven security procedures are a continuing cause for concern."

EQUAL ACCESS TO PUBLIC PROGRAMS: "All people should be able to access government services and publicly funded programs without fear that they will be turned away or mistreated because of who they are."

IMMIGRATION REFORM: "The government's failure to recognize LGBT families exacerbates the hardships on our community, and transgender people frequently find their relationships challenged regardless of the gender of their partner. For trans people who have legal status, documents that reflect the wrong gender contribute to the discrimination trans immigrants face."

PRISON AND DETENTION REFORM: "Nearly one in six transgender people (16%) (including 21% of transgender women) have been incarcerated at some point in their lives—far higher than the rate for the general population… These high rates of incarceration are driven by disproportionate poverty, homelessness, discrimination, participation in street economies, and in some cases, law enforcement bias. Trans people are also at high risk of abuse in prisons, jails, and juvenile detention."

OPEN MILITARY SERVICE: "The military maintains its own rules for who is eligible to serve, which can be changed without congressional action. The transgender ban is the result of archaic rules that treat transgender people as mentally and medically unfit, rules that are based on outdated, unfounded stereotypes."

HONORING OUR VETERANS: "Estimates put the number of transgender veterans in the hundreds of thousands… However, many of these veterans have been denied access to medical care and other services guaranteed through the Veterans Administration (VA), and have faced discrimination and harassment at VA facilities."

FAMILY AND RELATIONSHIP RECOGNITION: "Transgender people and their spouses can be impacted by the federal Defense of Marriage Act  even if they married as a different-sex couple under state law, due to inconsistent interpretation and application of the law by federal agencies."

ADVANCING GLOBAL HUMAN RIGHTS: "As a member of the Council for Global Equality, NCTE works with the Council to ensure that the United States uses its diplomatic, political, and economic influence to oppose human rights abuses that are too often directed at individuals because of their gender identity or sexual orientation."

People who care about religion should want to protect it from charlatans and spivs

Have you ever seen or experienced something that made you say "there should be a law against it?"

I did some weeks ago and I was so angry about it I wrote the law myself. The trigger was a free newspaper in my local bus from a local faith organisation. It promised "deliverance from curses" of all kinds and divine intervention in the lives of believers. To this purpose it peddled a 'miracle pack', made up of commonplace ingredients including salt and water and olive oil, for £10. Last month the broadcasting arm of this church was fined heavily by Ofcom, over broadcast testimonies to the healing power of its 'miracle soap'.

I had thought this kind of thing had been stamped out in Thomas Cromwell's crackdown on religious racketeers for Henry VIII (Cromwell thought that their money should go to himself and the King). Not a bit. The sale of miracles has become a very successful modern business, which preys particularly on poor and vulnerable people. Within half an hour's walk of my home in south-east London I can find dozens of churches and pastors promising some form of divine intervention in the lives of their faithful. They may not be as outrageous my local faith group, but some of them are clearly making substantial sums from their adherents. Brecht once wrote: "Why rob a bank when you can found one?" Today he could write: "Why found a bank when you can found a church?"

One may believe in the existence of miracles and other forms of divine intervention, but that does not mean believing that people should charge money for claiming to procure them. In the many accounts of miracles in the Old and the New Testaments, I cannot remember anyone presenting a bill to the beneficiaries. Indeed, Jesus got very angry with those nice money-changers in the temple, and committed a serious public order offence when he attacked their legitimate businesses.

I now think that there should be a specific law to stop miracle peddlers and anyone else using divine intervention as a sales aid. My effort is below. I have tried to catch everybody who might obtain, or try to obtain, anything of value from another person with a promise or threat with any supernatural origin – not just the sellers of 'miracle packs' but also the people who secure money or property from the dying with promises of divine favour in the next life. I have chosen the same penalty as for major offences of fraud.

My bill is sitting in two ministers' intrays: Norman Lamb MP, the new consumer protection minister, and Nick Hurd MP, who has the ghastly responsibility of being the minister for the 'big society'. So far it has stunned them into silence. Like other politicians of all parties, they may be frightened of offending any religious group, but that should not make them resist my bill. People who care about religion should want to protect it from charlatans and spivs. If a new law frightened any religious leader or sect away from promising blessings or curses in exchange for money, so much the better.

Anyway, if there is any brave MP or peer looking for a private member's bill – it's all yours.

Sale Of Supernatural Intervention (Prohibition) Bill 2012

An act to prohibit the obtaining of anything of value with the promise or threat of supernatural intervention, and for connected purposes

(1) it shall be an offence for any person to solicit or receive money or property or any valuable consideration with the promise or expectation of any form of supernatural intervention or favour;

(2) an offence under section (1) of this Act may be committed when a person sells or attempts to sell any goods or services with such a promise or expectation;

(3) an offence under section (1) of this Act may be committed when a person solicits or receives money or any valuable consideration with any threat of supernatural intervention or disfavour if payment is refused, delayed or reduced;

(4) without prejudice to the generality of the foregoing, in this Act the expressions "supernatural intervention", "supernatural favour" and "supernatural disfavour" include a) the performance of miracles b) the procuring of any change by supernatural intervention in the life of any person c) the acquisition or loss of grace or merit in the view of any supernatural being or any form of favourable or unfavourable treatment after death.

(5) A person guilty of an offence under this section shall be liable –
(a) on summary conviction, to imprisonment for a term not exceeding twelve months or to a fine not exceeding the statutory maximum or to both; and
(b) on conviction on indictment, to imprisonment for a term not exceeding ten years or to a fine or to both.

Judicial Activism on River-Linking Project

THE Supreme Court, in its activist avatar, has given many directions which are viewed as clear usurpation of the role of the executive and that of the legislature.

The latest one is its direction to inter-link rivers. As per its judgment, a committee is to be formed within one month (the judgment was delivered on February 27) to examine the project and suggest ways to implement it. On March 19, the Union Minister of State for Water Resources told Parliament that the committee has not been set up as the government is yet to get a signed copy of the judgment. Will the judgment be implemented?
Debate over the separation of powers has been going on for long, and many a time, it has acquired acrimonious dimension. Even the Prime Minister, Dr Manmohan Singh, on two different occasions, accused the judiciary of overreach. Often the legislature and the executive have complained of judicial activism which breaches the doctrine of separation of powers. All allegations of encroachment by the judiciary into the arenas of legislature and executive may not be correct as there are grey areas and the court is constitutionally bound to see to it that the law of the land is enforced. But sometimes, the encroachment is glaring and unconstitutional out and out.
Writ of Mandamus Issued
Recently, the Supreme Court issued a writ of mandamus directing the Union and state governments to implement the project of inter-linking of rivers, and set up a special committee to carry out the implementation laying down that the committee's decision shall supersede all administrative bodies created under the order of this court or otherwise and imposed a time limit of 30 days but graciously added 'preferably'. It also gave liberty to the amicus curiae to file contempt petition in case of non-compliance or default by any party. This is a blatant intrusion into the policy domain of the government. It is not only beyond the jurisdiction of the Supreme Court to give such directions but also beyond its competence to examine its implementation. Such a project with huge ramifications that may cause severe law-and-order problem as it may spawn internecine wars between states has to be examined by appropriate agencies and has to obtain statutory clearances under the Environment Protection Act and the Forest Conservation Act, and then it has to be ensured that procedure prescribed in the national rehabilitation policy is adhered to. Further, the technical feasibility is to be studied which the court is not equipped to do as it cannot direct a doctor how to operate upon a patient for a particular malady. Finally, its economic viability is to be examined by the Planning Commission from the national planning point of view, and only then the cabinet can take a decision.
The first direction, in this regard, was given by a bench headed by the then chief justice of India, Mr Justice (retd)   B N Kirpal on October 31, 2002. Mr Justice Kirpal superannuated the very next day and later when he was asked at the National Law School, Bangalore, as to how did he give such a direction which does not fall within its jurisdiction, he proffered an apologia that his order was not a direction but merely a recommendation. However, the Supreme Court gave a definitive direction to inter-link rivers which may never be implemented. Such judgments dent the credibility of the judiciary and then even those orders are not complied which must be complied.
Purely A Policy Issue
The proposal of interlinking rivers is a purely policy issue falling within the domain of the legislature and that of executive. Earlier, the Supreme Court conceded this and said that it was not open to the court to direct Parliament to legislate on it but kept the case open stating further: "The parties are at liberty to file in court any reports or papers containing studies in respect of the said project." The court also drew its own inferences conveniently. It issued notices to the Union and all states, but only the Union and the State of Tamil Nadu filed affidavits. In a typical display of petitio principii, the court concluded that the non-filing of counter affidavits by other states meant that they do not oppose the prayer for interlinking rivers, and thus, there was a consensus for it. If such conclusions can be drawn, the court should not adjourn cases when counter-affidavits are not filed. What is more, the court also recorded its anguish that the project should not take 43 years for completion as the perspective plan indicated in the report of the National Water Development Agency in May 2000 showed and it expressed the hope that it would be done in ten years.
When the Bihar Reorganisation Act, 2000, under which the state of Jharkhand was carved out of Bihar, was challenged on grounds of attracting several constitutional provisions, the Supreme Court issued notices to the Union and the state of Jharkhand, but neither filed the counter-affidavit. However, the case was never listed for hearing, leave alone the court concluding that they were not opposed to the prayer made in the PIL for setting aside the bifurcation of Bihar. The fact is that no state is prepared to part with its water. Tamil Nadu supports this project because it has to receive, not give, water. However, it also must be admitted that the then NDA government at the Centre wanted to carry forward this project and used the observation of the apex court in its favour, while the water-starved state of Tamil Nadu wanted it completed by judicial fiat. Many water-deficit states now want the Supreme Court's direction to be carried out without delay. In about ten years, only nine states replied to the Supreme Court's notice: three states (Assam, Sikkim and Kerala) said flat 'no' to the proposal, three (the Punjab, Bihar and Odisha) gave conditional okay, but the conditions are such that it cannot be done and only three states (Tamil Nadu, Rajasthan and Gujarat) said 'yes' but out of these three, Rajasthan and Gujarat have refused to share their water so far with other states; they want to take, not to give. Thus, Tamil Nadu is the only state which supports this proposal as it has to only receive water, not give it. It is almost certain that the order of the apex court will be implemented in defiance.
